Welcome to PipTax. These Terms of Use (the "Terms") govern your access to and use of the website at piptax.com and any tools, calculators, content and services made available through it (together, the "Service"). The Service is operated by Evander Labs, a company registered in England and Wales (company number ) with its registered office at 45 Albemarle Street, London W1S 4JL ("PipTax", "we", "us", "our").
By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. What PipTax is — and what it is not
PipTax is an informational cost-comparison and cost-education service. We model and compare the trading costs — spreads, commissions and swap/financing charges — that forex and CFD brokers charge, so that you can understand the true all-in cost of a trade (what we call your "PipTax").
PipTax is not:
- an investment, financial, tax or legal adviser;
- a broker, dealer or trading platform;
- a source of buy, sell or trading recommendations of any kind.
Nothing on the Service constitutes investment advice, a personal recommendation, or an invitation or inducement to trade any financial instrument. We compare costs and mechanics only. Any decision to open an account with a broker, or to place any trade, is yours alone.
2. Risk warning
Trading foreign exchange and contracts for difference (CFDs) carries a high level of risk and is not suitable for everyone. CFDs are complex instruments and come with a high risk of losing money rapidly due to leverage. The majority of retail investor accounts lose money when trading CFDs. You should consider whether you understand how these products work and whether you can afford to take the high risk of losing your money. We make no promises or projections of trading profit, ever. Lower trading costs do not make trading profitable and do not reduce market risk.
3. Accuracy of data and comparisons
Our version 1 comparisons are built from figures taken from brokers' published specifications (typical spreads, published commission schedules and published swap rates). This data is:
- indicative and modelled — it reflects published figures at the date shown against each dataset, not live market conditions, and is clearly labelled as sample data;
- subject to change — brokers may change their spreads, commissions, swaps and account terms at any time and without notice to us;
- dependent on your circumstances — the costs you actually pay will vary with your account type, trade size, timing, market conditions and residence.
We take reasonable care to keep our data current and, where we identify or are notified of an error, we will correct it promptly. However, we do not guarantee that any figure, comparison or ranking on the Service is accurate, complete or up to date at any given moment.
You are responsible for verifying, directly with any broker, its current pricing, account terms, product availability and regulatory status in your jurisdiction before opening an account or acting on anything you read on the Service.
4. Rankings and affiliate disclosure
The Service contains affiliate links. If you open an account with a broker through a link on the Service, we may receive a commission from that broker. Using our links does not change the published pricing available to you. Every page containing such links carries a disclosure line, and full details are set out in our Affiliate Disclosure.
Our comparisons and rankings are computed from cost data only. Affiliate relationships do not and cannot affect how any broker is ranked or scored on the Service.
5. Acceptable use
You may use the Service for your own personal, non-commercial information purposes. You must not:
- use the Service in any way that breaches applicable law or regulation;
- scrape, harvest, or systematically extract data from the Service, or access it by automated means, without our prior written consent;
- reproduce, republish, resell or redistribute our data, comparisons or content, in whole or in part, without our prior written consent;
- attempt to gain unauthorised access to the Service, its servers or connected systems, or interfere with its proper working (including introducing malware or conducting denial-of-service attacks);
- misrepresent our comparisons, rankings or data, or present them as advice or as a promise of trading outcomes;
- upload to the Service any material that is unlawful, infringing, or that you do not have the right to provide (this applies in particular to any account statements or files you submit to forthcoming features).
We may suspend or terminate your access to the Service if we reasonably believe you have breached these Terms.
6. Intellectual property
The Service and its content — including the PipTax name and logo, text, design, graphics, software, calculators, methodologies, data compilations and comparison outputs — are owned by or licensed to Evander Labs and are protected by copyright, database rights, trade mark and other intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to view and use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted. Broker names and trade marks referenced on the Service belong to their respective owners; their appearance does not imply endorsement of PipTax by any broker, or of any broker by PipTax.
7. Third-party sites and services
The Service links to third-party websites, including broker websites. We do not control and are not responsible for the content, terms, pricing or conduct of any third party. Your relationship with any broker — including the account terms you accept and the trades you place — is solely between you and that broker.
8. No warranty
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties, conditions, representations and other terms of any kind, whether express or implied, including any implied warranties of accuracy, completeness, satisfactory quality, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free.
9. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.
Subject to the paragraph above, and to the fullest extent permitted by law:
- we shall not be liable to you for any trading losses, loss of profits, loss of anticipated savings, loss of data, or any indirect or consequential loss, arising out of or in connection with your use of (or inability to use) the Service or your reliance on any content, data, comparison or ranking on it, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable;
- our total aggregate liability to you arising out of or in connection with the Service shall not exceed one hundred pounds sterling (£100).
If you use the Service as a consumer, nothing in these Terms affects your statutory rights.
10. Indemnity
You agree to indemnify us against any losses, liabilities and reasonable costs we incur arising from your breach of these Terms or your unlawful use of the Service.
11. Changes to the Service and to these Terms
We may update, change, suspend or withdraw any part of the Service at any time. We may also revise these Terms from time to time. When we do, we will update the "Last updated" date above and, where a change is material, take reasonable steps to bring it to your attention on the Service. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. If you do not agree to a change, you should stop using the Service.
12. General
- Entire agreement. These Terms, together with our Privacy Policy and Affiliate Disclosure, form the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
- Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours to a successor operator of the Service.
13. Governing law and jurisdiction
These Terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms or the Service, save that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in your local courts, and nothing in this clause deprives you of mandatory protections available under the law of your country of residence.
